1. Overview

Welcome to EOOQI. The terms “we,” “us,” and “our” refer to EOOQI.

These Terms of Service govern your use of our website, store, content, features, products, and services (the “Services”). Our store is powered by Shopify.

By using the Services, you agree to these Terms. Our Privacy Policy explains how we handle personal information, and our Returns & Refunds Policy explains our return procedures. Both policies are available on this website.

Nothing in these Terms limits any consumer rights or remedies that cannot lawfully be excluded.

2. Eligibility and Accounts

To place an order, you must be legally capable of entering into a binding contract under the laws applicable to you.

Please provide accurate and current information when placing an order, creating an account, or contacting us.

Where accounts are available, keep your login details secure and notify us promptly if you suspect unauthorized access. You may not sell or transfer your account without our permission.

3. Product Information and Safe Use

We aim to provide accurate product descriptions, images, dimensions, and specifications. Screen settings may affect how colors appear.

Please review the product listing before purchasing. Changes to listings apply to future purchases and do not alter the agreed terms of an accepted order.

Use products only for their intended purpose and follow the supplied instructions, warnings, and care guidance. Website content does not replace product safety instructions.

Products remain subject to applicable legal requirements concerning quality, safety, fitness for purpose, and conformity with their description.

4. Orders and Cancellations

Submitting an order is an offer to purchase. An automated order acknowledgment confirms receipt but does not, by itself, constitute acceptance. Acceptance occurs when we expressly confirm acceptance or dispatch your order.

We may decline an order before acceptance for reasonable grounds, such as unavailable stock, unsuccessful payment, suspected fraud, or delivery restrictions.

If an order cannot be fulfilled, we will notify you and refund any payment collected for the unfulfilled items.

Contact support@eooqi.com as soon as possible if you need to change or cancel an order. Once processing or dispatch has begun, changes may not be possible. This does not affect statutory cancellation or return rights.

We will not substitute products or increase the price of an accepted order without your agreement.

5. Prices and Payments

Prices and promotions may change for future orders. The price and currency applicable to your purchase are shown at checkout and in your order confirmation.

Applicable taxes, shipping charges, and other charges we collect will be displayed before you submit your order. Any customs duties or import charges payable separately will be explained where relevant.

Prices on this website may differ from prices on Amazon or other sales channels. Promotions may have additional terms, which apply to the relevant promotion.

You must use a payment method you are authorized to use and provide accurate billing information.

If we discover a material pricing or listing error affecting your order, we will explain the issue and any available options. We will not charge a higher price without your agreement. Any cancellation will comply with applicable law, and payments for cancelled items will be refunded.

6. Shipping and Delivery

Available delivery destinations, charges, and estimated delivery times are provided during checkout or in the relevant delivery information.

Estimated delivery times are not guarantees unless expressly stated. Carrier disruption, customs processing, or other circumstances may affect delivery.

If your order is delayed, missing, or damaged in transit, contact support@eooqi.com so we can investigate and arrange an appropriate resolution.

For consumer orders shipped using a carrier we arrange, the risk of loss or damage remains with us until you, or a person you nominate other than the carrier, receive the goods. Different rules may apply where you independently appoint a carrier we did not offer.

Nothing in this section limits your legal rights concerning delivery deadlines, cancellation, or refunds.

7. Returns, Refunds, and Exchanges

Website purchases are subject to our Returns & Refunds Policy and applicable consumer law.

Please contact support@eooqi.com for return instructions. Any requirement to contact us does not make statutory cancellation rights conditional on our approval.

If you purchased through Amazon, start your return, refund, or exchange request through “Your Orders” on the Amazon website where you placed the order. The relevant Amazon terms and your statutory rights apply.

8. Third-Party Websites and Tools

The Services may include links to Amazon, social media platforms, or optional third-party tools. Their own terms and privacy policies apply to your use of those services.

Purchases completed on Amazon or another third-party platform are governed by the terms applicable to that transaction.

We do not control independently operated third-party websites or tools. This does not exclude responsibility that applicable law requires us to accept.

9. Relationship with Shopify

EOOQI is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with EOOQI. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and EOOQI, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with EOOQI.

This section applies only to the extent permitted by law and does not exclude rights or liabilities that cannot lawfully be excluded.

10. Privacy

Our collection and use of personal information are described in our Privacy Policy.

Shopify also processes information in connection with hosting and supporting the store. Where applicable, its own privacy policy governs that processing.

11. Intellectual Property and Feedback

Website content, including text, images, videos, graphics, logos, and designs, belongs to EOOQI or the relevant rights holders.

You may browse the website and save information for personal, non-commercial use. Other uses require permission unless allowed by law.

If you voluntarily submit a review or other content for publication, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and reasonably format that content for operating and promoting the Services. This does not authorize misleading changes or override your privacy rights.

You must have the necessary rights to submit your content and disclose any incentive received for a review. We may remove unlawful, misleading, abusive, or infringing content.

Private customer support messages are not treated as permission to publish your information or use it in advertising.

12. Acceptable Use and Automated Access

You must not:

• Use the Services unlawfully or fraudulently.

• Impersonate another person or submit deceptive information.

• Infringe intellectual property, privacy, or other rights.

• Harass others or submit unlawful or abusive content.

Where appropriate and legally permitted, we will provide notice and an opportunity to resolve the issue.

Suspension or termination does not remove your rights relating to existing orders, refunds, or personal information.

We may change or discontinue website features, but this will not alter our obligations under accepted orders.

14. Warranties and Liability

We aim to keep the website available and accurate, but cannot guarantee uninterrupted access or error-free operation.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, mandatory product liability, or any other liability that cannot lawfully be excluded.

Your statutory rights concerning product quality, safety, description, delivery, and remedies remain unaffected.

For personal or household purchases, we do not accept liability for business losses arising from commercial use, such as lost business profits, except where applicable law requires otherwise.

We are not responsible for losses caused solely by your unlawful conduct or misuse of a product contrary to its instructions, except to the extent our own acts or omissions contributed to the loss or applicable law requires otherwise.

15. General Terms and Disputes

These Terms and the policies expressly incorporated into them govern your use of the Services and relevant website purchases. They do not override specific commitments made to you or rights provided by law.

If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not waive that right.

Any transfer of our rights or obligations will not reduce your rights under an existing contract.

Disputes are subject to applicable law and the jurisdiction of competent courts. Nothing in these Terms deprives consumers of mandatory protections or rights to bring proceedings in courts available to them under applicable law.
